This document is a general-purpose template written to align with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth). It is not legal advice. Placeholders in [square brackets] need your input, and the "Notes for Andrew" section at the end flags a few things worth checking with a solicitor before you publish this.

LP Commercial Photography & Videography ("LP Commercial", "we", "us" or "our") provides commercial photography and videography services to businesses across Brisbane and Australia-wide. We are committed to handling personal information responsibly and in accordance with the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth).

This policy explains what personal information we collect, how we collect and use it, who we share it with, and how you can access, correct, or make a complaint about the handling of your personal information.

1. About This Policy

This policy applies to personal information collected by LP Commercial through our website (www.lpcommercial.photography), email, phone, quote requests, and during the course of providing photography and videography services — including corporate portrait and headshot sessions, event coverage, architecture and construction photography, product photography, and drone and video production.

2. The Personal Information We Collect

Depending on how you interact with us, we may collect:

  • Contact and business details — name, business name, job title, email address, phone number, postal address and billing details, provided when you request a quote, book a shoot, or otherwise get in touch.

  • Images, footage and likeness — photographs, video, and drone footage of individuals who are photographed or filmed as part of a commissioned shoot (for example, staff attending a corporate headshot day, individuals appearing in event or lifestyle photography, or people incidentally visible in architecture, construction or product shoots).

  • Payment and invoicing information — details needed to invoice and process payment for our services. We do not directly store full credit card numbers; payments are processed through third-party payment or accounting providers (see section 7).

  • Website usage information — such as IP address, browser type, pages visited, and general location, collected automatically through cookies and analytics tools when you visit our website.

  • Correspondence — records of emails, calls and other communications between you and us relating to a booking or enquiry.

3. How We Collect Personal Information

We generally collect personal information:

  • directly from you, when you submit a contact or quote request form, email or call us, or provide a brief for a shoot;

  • during a photography, videography or drone session, from the individuals being photographed or filmed;

  • from a client organisation on behalf of the individuals it asks us to photograph (for example, an HR team providing a list of staff attending a headshot day) — client organisations are responsible for letting their staff know that LP Commercial will be photographing them and for directing staff to this policy if relevant;

  • automatically through our website, via cookies and analytics tools (see section 9); and

  • from third parties where reasonably necessary to deliver a booking (for example, a venue or event organiser coordinating a shoot).

4. Why We Collect, Hold, Use and Disclose Personal Information

We collect, hold, use and disclose personal information to:

  • respond to enquiries and provide quotes;

  • plan, deliver and invoice photography and videography services;

  • produce, edit, store and deliver final images and footage to clients;

  • communicate with clients about bookings, deliverables and account matters;

  • comply with our legal and accounting obligations; and

  • where you have agreed, send occasional marketing communications about our services (see section 6).

We do not sell personal information to third parties.

5. Photographic and Video Images

Images and footage of individuals are personal information, and we take particular care with how we handle them.

  • Ownership and delivery. Final images and footage are typically delivered to the client who commissioned the shoot (for example, a business commissioning corporate headshots or a construction project photographed for a builder). Individuals appearing in a shoot should direct requests about how their image is being used to the commissioning client in the first instance, and may also contact us directly (see section 10).

  • Retention. We retain raw and edited files for 2 years after delivery, primarily for backup and re-supply purposes, after which they may be archived or deleted.

  • Model releases. For shoots involving identifiable individuals — particularly where images may be used for marketing, portfolio or case-study purposes — we seek a model release or the commissioning client's confirmation that appropriate consent has been obtained from those photographed.

6. Marketing and Portfolio Use

With consent (obtained either directly or through the commissioning client, as appropriate to the shoot), we may use selected images and footage in our:

  • website portfolio and case studies;

  • social media channels (Instagram, Facebook, LinkedIn, YouTube); and

  • promotional and marketing materials.

If you or your organisation would prefer that images not be used in this way, let us know before or at the time of the shoot, and we will note this on the booking. You can also ask us to remove a specific image from public use at any time by contacting us (see section 15).

We may also send you marketing emails about our services if you have provided your details to us and have not opted out. You can unsubscribe at any time using the link in any marketing email or by contacting us directly.

7. Disclosure to Third Parties and Overseas Recipients

We may disclose personal information to third-party service providers who help us run our business, including:

  • cloud storage and online gallery/delivery platforms (for storing and delivering images and footage to clients);

  • accounting, invoicing and payment processing providers;

  • email and customer communication platforms; and

  • website hosting and analytics providers.

Some of these providers store or process data on servers located overseas — commonly in the United States or other countries in which our service providers operate [insert/confirm actual countries based on the specific platforms you use, e.g. your gallery delivery tool, accounting software and analytics provider]. Where practicable, we take reasonable steps to ensure overseas recipients handle personal information consistently with the Australian Privacy Principles.

We do not disclose personal information to third parties for their own marketing purposes.

8. Storage and Security

We store personal information, images and footage using a combination of secure local storage, backup drives and cloud-based storage services. We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure — including access controls, secure file storage, and limiting access to personal information to those who need it to deliver our services.

No method of storage or transmission is completely secure, and we cannot guarantee absolute security, but we review our practices periodically to keep them appropriate to the sensitivity of the information we hold.

9. Cookies and Website Analytics

Our website may use cookies and similar technologies (such as Google Analytics) to understand how visitors use the site and to improve its content and performance. Most web browsers let you control or disable cookies through their settings; doing so may affect how parts of our website function.

10. Access and Correction

You may request access to the personal information we hold about you, or ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. To make a request, contact us using the details in section 15. We will respond within a reasonable period and may need to verify your identity before providing access.

There is generally no charge for a straightforward access request, though we may need to charge a reasonable fee to cover the cost of retrieving and providing access to certain records.

11. Complaints

If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please contact us first using the details in section 15 so we can investigate and respond.

If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC):

12. Data Breaches

If we become aware of a data breach involving personal information that is likely to result in serious harm, we will assess and, where required, respond in accordance with the Notifiable Data Breaches (NDB) scheme, including notifying affected individuals and the OAIC where required by law.

13. Children and Minors

Our services are generally provided to businesses and adult individuals. If a shoot involves anyone under 18 (for example, at a company event), we rely on the commissioning client and/or parent or guardian to ensure appropriate consent has been obtained before the shoot.

14. Changes to This Policy

We may update this policy from time to time to reflect changes in our practices or legal obligations. The current version will always be available on our website, with the "last updated" date shown at the top of this page.
